Trường hợp lô hàng nhập khẩu của Công ty đến cảng nhập hơn 30 ngày rồi, nhưng vì thiếu một số chứng từ đang chờ nhà cung cấp bổ sung nên chưa thể khai báo hải quan để lấy hàng được. Như vậy, Công ty có bị phạt khi khai báo hải quan cho lô hàng đã về đến cảng quá 30 ngày hay không?

Trả lời:

- Căn cứ điểm a khoản 1 Điều 63 Nghị định số 127/2013/NĐ-CP ngày 15/10/2013 được sửa đổi, bổ sung tại Nghị định số 45/2016/NĐ-CP ngày 26/5/2016 của Chính phủ quy định:

“Điều 6. Vi phạm quy định về thời hạn làm thủ tục hải quan, nộp hồ sơ thuế

1. Phạt tiền từ 500.000 đồng đến 1.000.000 đồng đối với một trong các hành vi sau:

a) Không khai, nộp, xuất trình, cung cấp thông tin hồ sơ hải quan đúng thời hạn quy định, trừ vi phạm quy định tại Khoản 3, các Điểm a và b Khoản 4, Khoản 5 Điều này;”

Đề nghị công ty tham khảo nội dung quy định trên để thực hiện. Trường hợp phát sinh vướng mắc, đề nghị công ty liên hệ trực tiếp Chi cục Hải quan nơi đăng ký tờ khai để được hướng dẫn cụ thể.
