Theo Khoản đ Điểm 4 Điều 9 Quyết định số 53/2013/QĐ-TTg ngày 13/9/2013 của Chính Phủ về việc quy định điều kiện chuyển nhượng xe ô tô, xe gắn máy có quy định: Đối với xe gắn máy: Không được chuyển nhượng tại Việt Nam.

Như vậy, đối với trường hợp xe gắn máy đã qua sử dụng 04 năm, hết nhiệm kỳ công tác, chuyển nhượng cho cá nhân là người Việt Nam thì không được phép chuyển nhượng.
