According to Article 7 of Circular No. 19/2014 / TT-BTC, dated February 11, 2014 of the Ministry of Finance, records and procedures for the transfer of cars, when the term of office ends, are stipulated as follows:

1. Procedures for carrying out procedures: Procedures for granting transfer papers and transfer procedures shall be carried out at provincial / municipal Customs Departments where permits for temporary import of vehicles are issued.

2. Dossiers of application for assignment papers:

a) For motor vehicles

Request for transfer of vehicle: 01 original.

b) For personal vehicles

- Written request for vehicle transfer: 01 original certified by the agency where the person works in Vietnam; or the agency's written request for transfer (for cases prescribed by the subjects prescribed in Clauses 2 and 3, Article 2 of this Circular, to authorize the agency where the work to carry out the vehicle transfer procedures).

- Identification card issued by the Ministry of Foreign Affairs (for the subjects specified in Clauses 2 and 3, Article 2 of this Circular): 01 certified copy of the agency where the working person is located and presented the original for comparison. mat.

- Document of the Ministry of Foreign Affairs (State Department of Foreign Affairs or Department of Foreign Affairs of localities where consular offices are closed) on the transfer of vehicles: 01 original.

- Power of attorney for the agency where the person working for the procedure of transferring the vehicle: 01 original.

- Certificate of registration revocation and license plate issued by the police: 01 original.

- The customs declaration for temporary import of vehicles (the declarer) shall be stamped for "re-export or transfer according to law provisions": 01 copy certified by the temporary import border-gate Customs Sub-Department.

- Customs declaration of non-commercial import / export goods (HQ / 2011- PMD): 02 originals.

3. Procedures for granting transfer papers:

a) Responsibilities of the subjects stated in Clauses 1, 2 and 3, Article 2 of this Circular:

- Prepare all documents as prescribed in Clause 2 of this Article.

- Submit a dossier of application for a vehicle transfer paper specified in Clause 2 of this Article to the Customs Department of the province or city where the temporary import permit is issued.

b) Responsibilities of provincial / municipal Customs Departments where dossiers of application for vehicle transfer papers are received:

- Receive the application file, check the completeness and validity of the application file and check and compare with the transfer conditions stipulated in Article 9 of Decision No. 53/2013 / QD-TTg, if appropriate, then issue the next form receive a reply to the object of the transfer application and issue a transfer certificate within 5 working days from the date of receipt.

If the dossier is incomplete according to regulations, instructing the subjects to apply for a transfer paper to complete the dossier as prescribed.

In case of suspicion of a temporary import declaration prescribed at Point d, Clause 2 of this Article, the border-gate Customs Sub-Department shall request the procedures for temporary import of vehicles to provide information on temporary import declarations. Within 5 days after the re-export border-gate Customs Sub-Department issues a written request, the border-gate Customs Sub-Department carrying out the procedures for temporary import of vehicles shall have to supply information to the re-gate customs sub-department. - Each temporary import car is granted 01 set of transfer paper including 03 copies (according to Form No. 02: G / 2014 / CN-OTO-NG issued together with this Circular), the transfer paper must clearly state: Name agencies and addresses (for motor vehicles); full name and address (for individual vehicles) of the transferor and the object of the transfer; numbers, dates of temporary import papers, temporary import declarations, car marks, vehicle models (models), production years, manufacturing countries, paint colors, frame numbers, engine numbers, engine volumes.

- After granting a vehicle transfer certificate, assigning the applicant to issue a transfer paper with 02 copies for the subjects specified in Clauses 1, 2 and 3 to keep 01 copy and handing over to the assignee 01 copy for carrying out procedures. transfer.

- Update information on the management software system of the General Department of Customs for temporarily imported cars and motorcycles of diplomatic preferential subjects.

4. Transfer procedures:

a) Persons specified in Clauses 1, 2 and 3, Article 2 of this Circular, declare 02 customs declarations of non-commercial export / import goods (HQ / 2011-PMD).

b) Responsibilities of provincial / municipal Customs Departments where cars transfer papers are granted:

- Based on vehicle transfer papers and customs declarations specified at Point ..., Clause 3, Point a, Clause 4 of this Article and compare them with actual vehicles to carry out transfer procedures (including tax calculation and tax collection according to stipulated in Clause 5 of this Article, except for cases where the subjects buy cars, receive donations and gifts as prescribed in Clauses 1, 2 and 3, Article 2 of this Circular. Within 10 days from the date of receiving the dossier of application for vehicle transfer license, the Customs Department of the province or city shall complete the transfer procedures as prescribed.

- Pay 01 declaration of HQ / 2011-PMD (the declarer) and the receipt of tax collection to the object of transfer procedures or the authorized person to carry out the procedures to transfer the vehicle in accordance with the law to do the procedures. registration for vehicle circulation; or collect a copy of the paper of remittance into the state budget in cash or a check through the state treasury (certified by the State Treasury already receiving the money) or a paper of bank payment from the object of carrying out the procedures cede a vehicle or an authorized person to carry out a vehicle transfer procedure in accordance with law.
