From January 1, 2019, Vietnamese enterprises exporting goods to the EU will have to self-certify the origin of goods in order to enjoy the universal preferential tariff (GSP) C / O form A. This is a requirement. mandatory requirements of EU for some countries including Vietnam, the transition period is 6 months.
The responsibility of certifying the origin of goods will shift from specialized agencies to enterprises (or importers). This means that businesses (or importers) must carry out the procedures themselves, meet the standards of origin and take responsibility for accuracy. In addition, Vietnamese exporters will issue their own proof of origin, namely the declaration of origin information in trade documents (such as invoices) without the participation of regulators during the release process.
The process is: Vietnamese exporters submit applications for licensing to the Vietnamese customs authorities, the Customs examines the submission; on-site verification if necessary; deciding whether or not to license. In particular, self-certification of origin is valid for 5 years, if the exporter does not violate it.
The Ministry of Industry and Trade will not license enterprises eligible for self-certification of goods because the EU requires businesses to do when exporting goods to their countries. Currently, the Ministry of Industry and Trade is focusing on developing a circular guiding businesses to self-certify goods origin when exporting to the EU.
Pursuant to Regulation No. 2015/2447 of November 24, 2015 of the European Commission (EC) detailing a number of articles of Regulation No. 952/2013 of October 9, 2013 of the European Parliament and the Council European Union regulates the implementation of the Customs Union Code, the EC applies the mechanism of exporters self-certification of origin of goods (REX) to countries that benefit from the framework of the universal tariff incentive program. The REX mechanism will change the current system of certification of origin of form A goods. From January 1, 2019, Vietnam will officially join REX. For shipments valued at under 6,000 Euro, exporters are allowed to self-certify their origin without REX registration.
