Question: Let me ask in Incoterm 2010, Term DAP, which party will the unloading at the buyer 's warehouse belong to? Buyer or seller? In the contract, only DAP, Incoterm 2010 is written in general.
Answer: Term DAP (Delivered At Place) - Delivery at destination: according to Incoterms 2010 it belongs to Group D, the responsibility belongs to the seller
Some notes when using Incoterms:
- Incoterms only apply to foreign trade contracts that do not apply to foreign trade contracts.
- Incoterms only apply to sales contracts of physical goods (tangible), not applicable to intangible goods (invisible).
About the law of Incoterms:
- When applying Incoterms, the parties may agree to add other provisions contrary to Incoterms.
- Incoterms cannot replace international sales contracts, it is only part of an international sales contract.
- In case of transporting goods by container using water transport, should choose conditions FCA, CPT, CIP, instead of FOB, CFR, CIF. Should choose conditions in Incoterms so that Vietnamese businesses gain the right to hire ships and buy insurance for goods.
