The process of importing the toys of children

Answer: Regarding the company's problems, H-A Logistics Company would like to discuss as follows:

1. Import policy: In case the company is a Vietnamese trader without foreign direct investment, it is allowed to export or import goods regardless of the registered business lines, except for goods belonging to the Ministry of Industry and Trade. List of goods banned from export, temporarily suspended from export, List of goods banned from import or temporarily suspended according to Decree 187/2013/ND-CP dated November 20, 2013 of the Government. Pursuant to Article 9 of Circular 28/2014/TT-BVHTTDL dated December 31, 2014 of the Ministry of Culture, Sports and Tourism stipulating: “Article 9. Children's toys 1. Must be 100% new; unused.

2. Ensure the quality is consistent with the national technical regulations on safety of children's toys as prescribed in the Circular No. 18/2009/TT-BKHCN dated June 26, 2009 of the Ministry of Science and Technology on National technical regulation on safety of children's toys - QCVN 3:2009/BKHCN.

3. Having content, form, design, and usability features that are not harmful to education, or personality development, dangerous or affect the health of children, and do not violate the provisions of Article 3. 6 of this Circular. Children's toys that meet the above conditions are allowed to be imported into Vietnam. Import procedures shall be carried out at the customs office. Pursuant to Point 4.2, Clause 4, of the National Technical Regulation on safety of children's toys promulgated together with Circular 18/2009/TT-BKHCN dated June 26, 2009 of the Ministry of Science and Technology stipulating: “4.2. Imported children's toys 4.2.1. Imported children's toys must be certified in conformity with the provisions of Section 2 of this Regulation. The certification of conformity of imported children's toys is carried out by domestic and foreign assessment or certification organizations appointed (or recognized) by competent state management agencies. The certification of conformity is carried out by one of the following methods:- Method 1: testing of typical samples; - Method 5: testing typical samples and evaluating the production process; monitoring through testing of samples taken at the production site or on the market in conjunction with assessment of the production process; - Method 7: testing and evaluating batches of products and goods. 4.2.2. Imported children's toys must be affixed with the mark of conformity before being put on the market. Pursuant to Point 4.5, Clause 4, of the National Technical Regulation on safety of children's toys promulgated together with Circular 18/2009/TT-BKHCN dated June 26, 2009 of the Ministry of Science and Technology stipulating: “4.5. Regulation conformity certification, announcement of technical-regulation conformity, mark of conformity and methods of conformity assessment 4.2 and Point 4.3 of this Section comply with the Regulation on standard conformity certification, regulation conformity certification and standard-conformity announcement, regulation-conformity announcement promulgated together with the Minister's Decision No. 24/2007/QD-BKHCN Science and technology". According to regulations, imported children's toys must be certified for conformity before being put on the market. 2. Import procedures: Import customs procedures and documents comply with current regulations in Articles 16 and 18 of Circular 38/2015/TT-BTC dated March 25, 2015 of the Ministry of Finance. 3. HS code: Since the company only gives a general name as a children's toy without a specific name, we cannot give exact advice, the company can refer to the HS code of chapter 95. Before going through customs procedures, the company can apply for pre-determination according to the provisions of Article 7 of Circular No. 38/2015/TT-BTC dated March 25, 2015 of the Ministry of Finance.
