Import of Nicotine to produce functional foods (Tobacco cessation drugs)

Question:
The company already has a number of Functional Food Claims for detoxification products. Therefore, importing Nicotine raw materials does not need to apply for import permits and is applied at the Food Safety Department or Drug Administration and under any circular.

Reply:
Because the ingredients, names, chemical formulas as well as specific purposes of the goods to be imported have not been specified, the Company makes reference to specialized regulations to comply with:

1. / Imported goods used as medicine raw materials:

- Medicinal materials subject to special control under the List of goods exported and imported under permits and conditions under the management scope of the Ministry of Health in Appendix III promulgated under Decree No. 69/2018 / ND-CP dated May 15, 2018 of the Government, so when importing, there must be an import permit issued by the Ministry of Health.

- Dossiers and regulations on licensing import of medicinal materials subject to special control specified in Article 80 of Decree No. 54/2017 / ND-CP of May 8, 2017 are amended and supplemented in the Decree. Decree No. 155/2018 / ND-CP dated 12/11/2018 of the Government.

2. / Imported goods are functional foods:

- Functional foods on the list of goods being food, food additives, food processing aids and utensils, packaging materials, and food containers are identified with commodity codes according to the list. List of Vietnam's export and import goods issued under the Ministry of Health's Circular 05/2018 / TT-BYT dated April 5, 2018.

Therefore, the company researched to carry out the state inspection of imported food safety and announced the quality of imported goods under the management responsibility of the Ministry of Health for the categories of goods to be imported under regulations. Decree No. 15/2018 / ND-CP of the Government.

- The state inspection of food hygiene and safety complies with the Ministry of Health's Circular 52/2015 / TT-BYT dated December 21, 2015, providing for state inspection of food safety. Imported foods and dossiers and procedures for certification of exported foods under the management of the Ministry of Health
